Urge your legislators to co-sponsor legislation in both the U.S. Senate and the House of Representatives that would curb abusive DIR fees. S. 413, sponsored by Senators Shelley Moore Capito (R-W.Va.) and Jon Tester (D.-Mont) in the Senate and H.R.1038 sponsored by Representatives Morgan Griffith (R-Va.) and Peter Welch (D-Vt.) in the House, would explicitly prohibit PBMs in Medicare Part D from retroactively reducing payments to pharmacies for clean claims under prompt-pay provisions---effectively eliminating DIR clawbacks by PBMs. A recent report by Wakely Consulting Group also concluded that this legislation would save taxpayers $3.4 billion over the next 10 years.
