Have You Told the FTC About PBM Contracts Yet?

Dear APCI members,

Have you told the federal government how one-sided PBM contacts are affecting your business and livelihood yet? If your answer is no, NOW is the time!

The Federal Trade Commission is inviting public comments on contract terms that may be harmful to fair competition. The commission has heard from the public about a wide range of terms that disadvantage small businesses, workers, and/or consumers. Specific concerns have been raised about exclusivity provisions, non-compete clauses, and other one-sided contract terms.

As we all know, PBMs' "take-it-or-leave-it" contract terms disproportionately affect community pharmacies and their patients. With a new set of FTC commissioners now in office, this is the prime time to bring these unfair PBM practices to light.

Please take a few moments to urge the FTC to investigate unfair terms in PBM contracts and inform them of your own experiences of how these terms harm patient choice and competition. The deadline for comments is Friday, September 3.
